Welcome to RUSH DTF TRANSFER. RUSH DTF TRANSFER ("Company," "we," "our," or "us") is a business operated by OZ & FSK LLC.

We operate this website and online store, including all related information, content, features, tools, products, printing services, and customer services (collectively, the "Services"). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms & Conditions, together with all policies referenced in them, describe your rights and responsibilities when you visit our website, upload artwork, place an order, purchase our products, or otherwise use our Services.

Please read these Terms carefully. They contain important information regarding order processing, customer artwork responsibilities, intellectual property rights, warranty disclaimers, and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms & Conditions, our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree to these Terms or our policies, you should not access or use the Services.

1. Eligibility, Access, and Accounts

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence. If you permit a minor to use the Services through a device, account, or payment method that you own or control, you accept responsibility for that use.

To browse our store, upload files, place an order, or purchase products, you may be required to provide information including your name, email address, billing address, shipping address, telephone number, and payment information.

You represent and warrant that all information you provide is accurate, current, complete, and authorized for your use.

You are responsible for maintaining the confidentiality and security of your account credentials. You are also responsible for all activity occurring through your account. You may not sell, assign, transfer, or license your customer account to another person.

2. Our Products and Services

RUSH DTF TRANSFER provides custom-made printing products and related services, which may include:

• Direct-to-Film (DTF) transfers
• DTF gang sheets
• Custom-sized transfers
• Upload-your-own-artwork printing
• Gang sheet building services
• UV DTF transfers
• Other custom printed products and related services

Most of our products are custom manufactured according to files, sizes, quantities, specifications, and selections submitted by the customer.

We make reasonable efforts to provide accurate descriptions and visual representations of our products. However, product colors, textures, sizing, brightness, and appearance may differ from what is displayed on your monitor, tablet, or mobile device.

We do not guarantee that the appearance of a printed product will exactly match the appearance displayed on your screen.

Product descriptions, prices, specifications, availability, and production methods may be changed at any time without prior notice. We reserve the right to discontinue products, restrict quantities, or limit sales by customer, geographic region, jurisdiction, or order type.

3. Order Acceptance

Submitting an order constitutes an offer to purchase products or services from RUSH DTF TRANSFER.

We reserve the right to accept, reject, place on hold, modify, or cancel any order at our discretion, including orders involving:

• Suspected fraud or unauthorized payment activity
• Incorrect pricing or website errors
• Prohibited or unlawful artwork
• Copyright or trademark concerns
• Files that cannot be produced successfully
• Abusive, threatening, or fraudulent customer activity
• Products or quantities that are unavailable

An automated order confirmation does not necessarily mean that an order has been accepted for production. An order is accepted when payment has been successfully processed and we begin processing or producing it.

If we reject or cancel an order before production, we will attempt to notify you using the contact information supplied at checkout.

4. Custom-Made Products

Our printed transfers and related products are produced specifically for each customer. Because these products are custom-made, they generally cannot be restocked, resold, returned, or exchanged.

Returns, replacements, refunds, and exchanges are governed exclusively by our Refund Policy.

Customers must carefully review all files, dimensions, quantities, product selections, shipping information, and order details before completing checkout.

5. Order Cancellations and Modifications

Orders may be canceled within one hour of purchase, provided production has not begun.

After the one-hour cancellation period has expired, or once production has started, the order cannot be canceled, changed, modified, or refunded because it is being produced specifically for the customer.

Requests to cancel or modify an order must be emailed immediately to info@rushdtftransfer.com.

We will make reasonable efforts to assist with timely requests, but we cannot guarantee that an order can be stopped or modified once it has entered our production workflow.

6. Customer Artwork Responsibility

Customers are solely responsible for all artwork, images, logos, text, files, dimensions, colors, layouts, and instructions submitted with an order.

Before submitting an order, you are responsible for confirming that your artwork:

• Uses the correct dimensions and orientation
• Has sufficient image resolution
• Contains the intended spelling, grammar, names, and wording
• Includes a transparent background when transparency is required
• Does not contain unintended backgrounds, borders, shadows, or objects
• Uses colors appropriate for the intended result
• Contains all required design elements
• Complies with our artwork and file preparation guidelines

We are not responsible for errors contained in customer-submitted artwork, including spelling errors, incorrect dimensions, missing design elements, low resolution, pixelation, unwanted backgrounds, incorrect colors, wrong files, or layout mistakes.

7. Files Are Printed as Submitted

Unless you have purchased and received confirmation of a separate artwork editing or design service, files are printed substantially as uploaded and submitted by the customer.

RUSH DTF TRANSFER does not automatically:

• Proofread customer text
• Correct spelling or grammar
• Resize designs to different dimensions
• Remove backgrounds
• Improve low-resolution images
• Correct colors
• Rearrange gang sheets
• Inspect files for every possible artwork error

Any informal review performed by our team does not transfer responsibility for the artwork from the customer to RUSH DTF TRANSFER.

8. Artwork Resolution and File Quality

For best results, we recommend submitting artwork at the final intended print size with a resolution of approximately 300 DPI.

PNG files with transparent backgrounds are generally recommended when transparency is required. Other file formats may be accepted when supported by our upload system.

Low-resolution, compressed, blurry, pixelated, enlarged, screenshot-based, or otherwise poor-quality files may produce poor-quality prints.

Printing a low-resolution image does not improve its quality. RUSH DTF TRANSFER is not responsible for print-quality issues caused by the condition or quality of the original customer file.

9. Transparent Backgrounds

Customers are responsible for confirming whether their uploaded artwork contains a transparent background.

A white, colored, black, checkered, or otherwise visible background contained within an uploaded file may be treated as part of the artwork and may be printed.

RUSH DTF TRANSFER is not responsible for unintended printed backgrounds when the customer submits a file that does not contain true transparency.

10. Gang Sheet Responsibility

Customers who upload or build gang sheets are responsible for the complete gang sheet layout.

This includes responsibility for:

• Gang sheet dimensions
• Artwork size
• Spacing between designs
• Artwork orientation
• Quantity of each design
• Image resolution
• Transparent backgrounds
• Cutting space
• Overlapping or cropped artwork

We do not guarantee that improperly spaced, overlapping, cropped, or incorrectly sized designs will be corrected before production.

If the customer submits a completed gang sheet, the submitted layout will be treated as approved for printing.

11. Artwork Created With Artificial Intelligence

Customers may submit artwork created or modified using artificial intelligence tools. However, the customer remains solely responsible for reviewing the final file for quality, accuracy, spelling, unwanted objects, distorted elements, intellectual property concerns, and other errors.

RUSH DTF TRANSFER does not guarantee that AI-generated artwork is original, legally protected, free from third-party rights, or suitable for commercial use.

12. Copyright, Trademark, and Artwork Rights

By uploading, submitting, emailing, or otherwise providing artwork to RUSH DTF TRANSFER, you represent and warrant that:

• You own the artwork; or
• You have received all permissions, licenses, and authorizations required to use, reproduce, modify, print, and distribute the artwork.

This requirement applies to all copyrighted material, trademarks, logos, brand names, photographs, illustrations, characters, slogans, artwork, and other intellectual property.

You may not submit artwork that unlawfully infringes or misappropriates the copyrights, trademarks, privacy rights, publicity rights, or other rights of any third party.

RUSH DTF TRANSFER is not responsible for determining whether customer-submitted artwork violates the rights of another person or entity.

We reserve the right to reject, cancel, or refuse to print any artwork that we reasonably believe may be illegal, infringing, fraudulent, hateful, threatening, obscene, defamatory, or otherwise inappropriate.

13. Intellectual Property Claims

If you believe that artwork or content processed through our Services infringes your intellectual property rights, please contact us at info@rushdtftransfer.com.

Your notice should include:

• Your full name and contact information
• Identification of the protected work
• Identification of the allegedly infringing content
• An explanation of your ownership or authority
• A good-faith statement regarding the alleged unauthorized use
• Any supporting registrations, links, screenshots, or documentation

We may request additional information and may suspend or refuse production while a claim is reviewed.

14. Limited License to Process Customer Artwork

By submitting artwork, you grant RUSH DTF TRANSFER and its service providers a limited, non-exclusive license to store, access, reproduce, process, resize, transmit, and print the artwork solely as reasonably necessary to fulfill your order, provide customer service, maintain production records, prevent fraud, and comply with legal obligations.

You retain ownership of your artwork, subject to any rights held by third parties.

15. Color Variations

Colors displayed on screens may differ from final printed colors because monitors and mobile devices use different display settings, brightness levels, color profiles, and calibration.

The printing process may also produce reasonable color variations based on ink, film, powder, artwork settings, substrate, heat press settings, garment color, and production conditions.

Minor color differences between screen previews and physical prints do not constitute a defect.

Exact color matching, including exact Pantone matching, is not guaranteed unless a specific color-matching service has been expressly agreed to in writing.

16. Production and Manufacturing Tolerances

Custom printing may involve minor variations in color, alignment, dimensions, trimming, film placement, powder coverage, or sheet positioning.

Reasonable variations that do not materially prevent the transfer from being used for its intended purpose are considered normal manufacturing tolerances and do not qualify as defects.

17. Test Pressing and Application Responsibility

Customers are responsible for confirming that transfers are compatible with their garments, fabrics, products, heat presses, pressing equipment, and intended application.

We strongly recommend performing a test press before applying transfers to valuable garments, customer-owned items, bulk production, or finished merchandise.

Application instructions are general guidance only. Actual results may vary based on:

• Heat press calibration
• Temperature accuracy
• Pressure
• Pressing time
• Fabric composition
• Moisture
• Garment treatments or coatings
• Peeling method
• Repressing method
• Operator technique

RUSH DTF TRANSFER is not responsible for damage caused by incorrect application, excessive heat, insufficient heat, incorrect pressure, improper peeling, incompatible materials, equipment malfunction, or failure to follow instructions.

18. Garments and Customer-Owned Property

Unless expressly agreed otherwise in writing, RUSH DTF TRANSFER is selling printed transfers and is not responsible for garments or other products onto which the transfers are applied by the customer or another party.

Our liability does not include the cost of blank garments, finished apparel, labor, lost production, customer penalties, lost profits, or other consequential costs resulting from an application problem.

19. Production Times

Production times displayed on our website are estimates and begin after:

• The order has been submitted
• Payment has been successfully processed
• Required artwork has been received
• Any requested information or approval has been provided

Most standard orders are processed within the production timeframe stated on our website. However, production may take longer during peak periods, holidays, sales events, equipment maintenance, large-volume orders, file issues, or circumstances beyond our control.

Production times are separate from shipping transit times.

20. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

All delivery dates and transit times are estimates unless expressly stated otherwise in writing.

RUSH DTF TRANSFER is not responsible for delays caused by carriers, weather, customs, transportation disruptions, incorrect addresses, holiday volume, or circumstances beyond our control.

Tracking may initially display “Label Created” or similar wording until the shipping carrier physically receives and scans the package.

21. Prices, Billing, and Payments

Prices, discounts, promotions, product availability, and shipping charges may change without notice.

The price charged will generally be the price displayed when the order is submitted, subject to correction of website, calculation, or pricing errors.

Unless expressly stated otherwise, displayed prices do not include applicable sales tax, shipping, customs duties, import fees, brokerage charges, or other government-imposed costs.

You agree to provide accurate, current, and complete billing and payment information.

You represent and warrant that:

• You are authorized to use the payment method provided
• The payment information is accurate
• Charges submitted through your payment method will be honored
• You will pay all charges associated with your order

22. Pricing Errors

We reserve the right to correct typographical, technical, pricing, shipping, discount, availability, or calculation errors at any time.

If an order contains a material pricing or system error, we may cancel the order and issue a refund rather than fulfill it at the incorrect price.

23. Promotions, Coupons, and Discounts

Promotional offers, discount codes, free-shipping offers, and coupons may be subject to separate conditions.

Unless expressly stated otherwise:

• Discounts cannot be combined
• Discounts cannot be applied after an order is placed
• Discounts have no cash value
• Discounts may exclude certain products or services
• Promotions may be modified or discontinued without notice

We reserve the right to cancel orders involving misuse, duplication, manipulation, unauthorized distribution, or fraudulent use of promotions.

24. Fraud Prevention and Order Verification

We may review orders for suspected fraud, payment risk, unauthorized activity, unusual order patterns, or inconsistencies in billing and shipping information.

We may request identification, payment verification, address confirmation, or other supporting information before accepting or producing an order.

Failure to provide requested verification may result in delay or cancellation.

25. Chargebacks and Payment Disputes

Customers should contact RUSH DTF TRANSFER before initiating a chargeback or payment dispute so that we have an opportunity to investigate and resolve the issue.

Filing a chargeback does not cancel these Terms or eliminate responsibility for valid charges.

We reserve the right to provide the payment processor or financial institution with relevant evidence, including:

• Order confirmations
• Customer communications
• Uploaded artwork
• Production records
• Shipping records
• Tracking information
• Delivery confirmation
• Website and policy acceptance records

Fraudulent chargebacks, false claims, or attempts to obtain both the product and a payment reversal may result in account restrictions, collection activity, or other remedies permitted by law.

26. Store Intellectual Property

The Services, including our website design, text, graphics, logos, product descriptions, photographs, videos, page layouts, software, branding, and other content, are owned by or licensed to RUSH DTF TRANSFER, OZ & FSK LLC, Shopify, or their respective licensors.

These materials are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, commercially exploit, scrape, store, transmit, or create derivative works from our website content without prior written authorization.

The RUSH DTF TRANSFER name, logo, product names, designs, and slogans may not be used without our written permission.

27. Optional and Third-Party Tools

We may provide access to third-party tools, applications, file upload systems, gang sheet builders, payment systems, shipping services, analytics services, or other integrations.

These tools may be provided “as is” and “as available.” We may not control, monitor, or guarantee their uninterrupted operation.

Your use of third-party tools is at your own discretion and may also be governed by the terms and policies of the applicable provider.

28. Third-Party Links

Our Services may contain links to websites, resources, or services operated by third parties.

We are not responsible for the content, accuracy, availability, privacy practices, security, products, or services of third-party websites.

Any transaction or interaction with a third party is solely between you and that third party.

29. Relationship With Shopify

RUSH DTF TRANSFER is powered by Shopify, which provides the ecommerce platform used to offer the Services.

All purchases from our store are made directly between you and RUSH DTF TRANSFER. Shopify is not the seller of our products and is not responsible for the production, quality, fulfillment, shipping, application, or use of products purchased from RUSH DTF TRANSFER.

To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from transactions between you and RUSH DTF TRANSFER.

30. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be collected and processed by Shopify and other service providers involved in payment processing, fraud prevention, analytics, shipping, communication, and order fulfillment.

31. Customer Reviews, Feedback, and Submissions

If you submit reviews, photographs, feedback, ideas, suggestions, comments, testimonials, or other content, you grant RUSH DTF TRANSFER a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, and adapt that content for operating, improving, and promoting the Services.

You represent that your submission:

• Is accurate and based on your genuine experience
• Does not violate another party's rights
• Does not contain unlawful, defamatory, threatening, obscene, or misleading material
• Does not contain malicious code, spam, or unauthorized advertising

We may monitor, refuse, edit, or remove submissions at our discretion.

32. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, production times, transit estimates, availability, or other matters.

We reserve the right to correct errors, update information, or cancel affected orders at any time, including after an order has been submitted.

33. Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services:

• To violate federal, state, local, or international laws
• To infringe intellectual property rights
• To submit unlawful, fraudulent, defamatory, threatening, hateful, or obscene content
• To harass or threaten employees, contractors, customers, or other persons
• To submit false or misleading information
• To distribute spam, malicious code, viruses, or harmful software
• To impersonate another person or organization
• To interfere with website security or operation
• To scrape, extract, copy, or commercially exploit website content without authorization
• To circumvent technical restrictions or fraud-prevention controls
• To misuse promotions, payment systems, or customer accounts

We may suspend or terminate access to the Services if we believe these Terms have been violated.

34. Termination

We may suspend, restrict, or terminate your access to all or part of the Services at our discretion if you violate these Terms, engage in unlawful or abusive conduct, create payment risk, or interfere with our business operations.

Termination does not eliminate obligations or amounts that arose before termination.

Provisions concerning intellectual property, artwork rights, payment obligations, disclaimers, limitations of liability, indemnification, governing law, and dispute obligations will survive termination.

35. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services and products are provided on an “as is” and “as available” basis.

Except as expressly stated in writing by RUSH DTF TRANSFER, we disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, durability, title, non-infringement, and uninterrupted or error-free operation.

We do not guarantee that:

• The Services will always be available or error-free
• Every customer file will produce the expected visual result
• Printed colors will exactly match screen colors
• Transfers will be compatible with every material or application method
• Carrier delivery estimates will be met
• Customer application will produce a particular result

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

36. Limitation of Liability

To the fullest extent permitted by law, RUSH DTF TRANSFER, OZ & FSK LLC, Shopify, and their respective owners, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages.

This includes, without limitation:

• Lost profits or revenue
• Lost business opportunities
• Lost production time
• Lost data
• Replacement garment costs
• Customer labor costs
• Missed deadlines or events
• Damage caused during transfer application
• Carrier delays or delivery failures

Where liability cannot lawfully be excluded, our total liability relating to an order will not exceed the amount paid to RUSH DTF TRANSFER for the specific product or order giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

37. Indemnification

You agree to indemnify, defend, and hold harmless RUSH DTF TRANSFER, OZ & FSK LLC, Shopify, and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from claims, damages, liabilities, losses, costs, and reasonable attorneys' fees arising from:

• Your breach of these Terms
• Your violation of applicable law
• Your uploaded artwork or customer content
• Claims that your artwork infringes third-party rights
• Your misuse of the Services
• Your application or resale of printed products
• Your false, misleading, or fraudulent statements

38. Force Majeure

RUSH DTF TRANSFER will not be responsible for delay, interruption, or failure caused by events beyond our reasonable control.

Such events may include:

• Severe weather
• Natural disasters
• Fire or flood
• Power or internet outages
• Equipment failure
• Supply shortages
• Carrier disruptions
• Labor disputes
• Government actions
• Public health emergencies
• War, terrorism, or civil unrest
• Failures of third-party platforms or service providers

39. Electronic Communications

By using our Services or contacting us electronically, you consent to receive communications from us electronically, including order confirmations, invoices, shipping updates, policy notices, customer service communications, and other transactional messages.

You agree that electronic communications satisfy any legal requirement that communications be provided in writing.

Marketing communications will be sent only as permitted by applicable law and may include an available opt-out method.

40. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

41. Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

42. Entire Agreement

These Terms, together with the policies and operating rules posted on our website, constitute the entire agreement between you and RUSH DTF TRANSFER regarding use of the Services.

They supersede prior or contemporaneous communications, discussions, representations, or agreements concerning the same subject matter.

43. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale, restructuring, change of ownership, or transfer of business operations.

44. Governing Law and Jurisdiction

These Terms and any dispute arising from or relating to the Services, products, orders, or transactions will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

To the extent permitted by law, the parties consent to the exclusive jurisdiction and venue of the applicable state and federal courts located in New Jersey.

45. Headings

Section headings are included for convenience only and do not limit or alter the interpretation of these Terms.

46. Changes to These Terms

We reserve the right to update, revise, or replace these Terms by posting an updated version on this page.

Changes become effective on the date stated in the updated Terms, unless applicable law requires otherwise.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
